These Terms of Use govern your access to and use of the Possible Finance website and services. By using our website or services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Description of Service

Possible Finance operates as a loan connection service. We connect consumers seeking personal installment loans with participating lenders in our network. We are not a lender and do not make loans or credit decisions.

By submitting an application through our platform, you authorize us to share your information with participating lenders and service providers for the purpose of evaluating your loan request.

2. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Be a legal resident of the United States
• Reside in a state where our services are available
• Have a valid email address, phone number, and bank account
• Have the legal capacity to enter into binding contracts

Our services are not available in New York, Vermont, Arkansas, or West Virginia.

3. Application Process

When you submit an application:

• You represent that all information provided is true, accurate, and complete
• You authorize us to verify your information with third parties, including credit bureaus
• You consent to credit inquiries that may affect your credit score
• You authorize us to share your information with participating lenders and service providers
• You understand that submission does not guarantee approval

4. No Guarantee of Approval

Submitting an application through Possible Finance does not guarantee that you will receive a loan offer. Loan approval decisions are made entirely by participating lenders based on their own underwriting criteria. We have no control over whether you are approved or the terms you may be offered.

5. Loan Terms

If you receive a loan offer from a lender:

• You will enter into a direct loan agreement with that lender, not with Possible Finance
• All loan terms, including APR, fees, and repayment schedule, are determined by the lender
• You are responsible for reading and understanding all loan terms before accepting
• You are responsible for making all payments on time according to the loan agreement
• Possible Finance is not a party to your loan agreement and has no obligations under it

6. Fees

Possible Finance does not charge consumers any fees for using our loan connection service. However, lenders may charge fees as part of their loan terms. All lender fees will be clearly disclosed to you before you accept a loan offer.

7. Privacy and Data Use

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.

8. Communications

By providing your phone number and email address, you consent to receive communications from us and our partners via phone, email, and text message. These communications may include:

• Updates about your application status
• Marketing and promotional offers
• Service-related announcements
• Requests for information or documentation

You may opt out of marketing communications at any time, but service-related communications are necessary for providing our services.

9. Prohibited Conduct

You agree not to:

• Provide false, inaccurate, or misleading information
• Impersonate another person or misrepresent your identity
• Use our services for any illegal purpose
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt our services or servers
• Use automated tools to access or interact with our website

• Warranties of merchantability or fitness for a particular purpose
• Warranties that our services will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of information provided by lenders
• Warranties that you will be approved for a loan or receive favorable terms

12. Limitation of Liability

To the maximum extent permitted by law, Possible Finance and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, or punitive damages arising from:

• Your use or inability to use our services
• Any loan agreement you enter into with a lender
• Unauthorized access to your information
• Errors or omissions in our content
• Any other matter relating to our services

Our total liability to you for any claim arising from your use of our services will not exceed $100.

13. Indemnification

You agree to indemnify and hold harmless Possible Finance and its affiliates from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your violation of these Terms
• Your violation of any law or third-party rights
• Your use of our services
• Any information you provide to us

14. Dispute Resolution and Arbitration

Any dispute arising from these Terms or your use of our services will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify. By agreeing to these Terms, you waive your right to a jury trial and to participate in class action lawsuits.

The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitrator's decision will be final and binding.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any legal action not subject to arbitration must be brought in the state or federal courts located in Dallas County, Texas.

16. Changes to Terms

We may modify these Terms at any time by posting updated Terms on our website with a new "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Possible Finance regarding your use of our services.
